Zhan In Zhan, History of advocacy, definition of advocate and his legal position in the pre-trial judicial procedure in the People’s Republic of China.

Abstract: In this article the author reviews the development of advocacy in the history of China. The analysis leads to the conclusion that the careful attitude of the state to the advocate, as a representative of person, today has deep historical roots. For a long time a person, including advocate, had no procedural rights and freedoms, was a victim of the statehood. The author establishes the definition of advocate and his legal position in the pre-trial procedures under the existing criminal law, forms some offers for amendment.
