Abstract: The article is devoted to the key categories and theories, which lay at the base of the modern approaches to legislative and doctrinal criminal punishment and practice of its implementation. The author gives as historically based analysis of the evolution of the views of the greatest philosophers, sociologists and lawyer on law and justice. The author provides evaluation of the Chinese doctrine on the Western philosophical and legal thought on functions and goals of punishment.
