Abstract: When considering the institution of legal responsibility in the USSR of the 30s, a difficult dilemma arises. How to avoid one-sided assessments and judgments when analyzing the pre-war period of Soviet history? As the author notes, the solution of the problem is seen in the acceptance of the conclusion about the existence of duality in state policy, in legal manifestation and, accordingly, as a characteristic feature of the institution of legal responsibility of this period.
