Smbatyan, A.S. The first decision of the Eurasian Economic Community: the bank of authority.Abstract: The article is devoted to the analysis of value of the Decision of the EEC Court of September 5, 2012 on the challenges against p.1 of the Decision of the Commission of the Customs Union of August 17, 2010 N. 335 ?On the topical issues related to the functioning of the united customs territory and the practice of implementation of the mechanisms of the Customs Union?. In particular, the Court upheld the principle of unity of legislation, prohibition of unjustified discrimination or hidden limitations to trade, as well as the right of economic entities to access to justice. At the same time, the author points out that not all of the conclusions of the court fall within the same logical path.
