Smbatyan, A.S. Customary norms of international law and general principles as a source of judicial law-making.Abstract: Unlike the national systems of law, where written law guarantees an exhaustive legal regulation of social relations, in the sphere of international life such a role is given to a customary international law. Establishment of application of international custom and the general principles of the international law provides considerable opportunities of the judicial law-making. The conclusions of the ICTY in this sphere provided much input into development of the international criminal law.
