Anti-Corruption and Illicit Enrichment as its Economic Manifestation

Abstract:
Today, corruption, in accordance with the Economic Security Strategy of the Russian Federation for the period up to 2030, is considered as one of the key internal threats to the economic security of the country. However, practice shows that it not only destroys the mechanism of state administration from within, but is increasingly being used by the West to exert pressure and induce certain Russian officials who have illegal assets abroad to engage in illegal cooperation. In this regard, the creation and development of effective mechanisms to counter illegal enrichment of officials will help to undermine the economic foundations of corruption. The work uses dialectical and comparative legal methods, a systematic approach, tabular interpretation of empirical and factual information. The article explores the genesis of the legal institution of responsibility for illicit enrichment, foreign experience of its regulatory consolidation. Analyzed attempts to criminalize illicit enrichment in Russia. The positions of domestic scientists regarding the expediency of its criminalization at the present stage of development of the Russian legal system are considered. The authors' approach is proposed to fix in the criminal law of Russia responsibility for illegal enrichment of officials. The authors come to the conclusion that a characteristic feature and the ultimate goal of all corruption offenses is the focus on obtaining benefits (illicit enrichment). Illegal enrichment of officials is a serious threat to the economic security of the Russian Federation. In this regard, the criminal law of Russia should provide for liability for the acquisition by an official of the ownership or use of assets, the value of which significantly exceeds the legal income of this person and his wife (spouse), as well as for the acquisition of such assets in the interests of third parties.

Abstract:
The subject of the research is the grounds of border guards activities at the levels of state and region. The most important objective of national borderline policy should be generalization of international experience and use of this experience in Russia's practice. The authors of the article focus on such issues as the principles of distribution of limited borderline resources among regions and districs as well as development of mechanisms for grounding activities of border guards (concentration of the main and auxiliary efforts). To achieve this task, the authors have applied approaches described in the theory of borderline security, methods of mathematical statistics and borderline statistics. The scientific novelty of the research is caused by the importance of prevention of terrorism, drug smuggling and illegal migration. Taking into account the limited nature of human, material and financial resources, the authors of the article develop their own mathematical model for substantiation of border guards activities and verify it using statistical data about the results of the USA border guards.

Social sphere development as a precondition for human capital assets reproduction (the case of Volgograd region)

Abstract:
Human capital assets accumulation is one of the “engines” of economic growth and the key factor of economic and social wellbeing of contemporary societies. The research subject unites the processes and conditions of human capital assets reproduction. The research object is the condition of “human forming” sectors of the economy in Russian regions, particularly, in Volgograd region. The authors analyze the processes of human capital accumulation in Volgograd region in comparison with the Russian Federation and the Southern Federal District, and offer the methods of its accretion. Special attention is paid to the recent changes in Russian legislation determining the reduction of social expenditures both on the federal and on the regional levels. The authors apply general scientific methods of analysis, synthesis, the dialectical method, system analysis, and comparative analysis. For human capital assets accretion calculation in the regions of the Southern Federal District the authors use the method of national wealth accretion calculation model introduced by M.V. Ledenyova, and statistical and mathematical methods. The authors come to the conclusion that human capital assets reproduction in the region and in the country is the result of a complex interaction between the state, the population, and the business structures, and the most important investment sources are the federal spendings on the educational system, public health service, and social protection, and the citizens’ personal incomes, primarily, the salaries. For human capital accumulation it is necessary to form the investment basis for human capital reproduction and development, and to intensify the state participation in organizing the process of its accumulation via strengthening and development of state structures in these spheres. The human capital accretion in the regions of the Southern Federal District in 2010 – 2014 is calculated according to the formula of human capital relative gain of M.V. Ledenyova. The analysis defines the tendencies of human capital gain in Volgograd region.

Abstract:
The research object is federalism as a form of state structure which has the right to solve the state problems of ethnic, national, socio-economic, and political and legal character. The research subject is the search for a state structure model in contemporary Russia leading to the transformation of federalist relations. The paper exposes the essence of federalism, and the problems of federalist relations development in modern Russia. The author studies various approaches to defining the state structure model in the Russian Federation, striving to find the optimal one, since it touches upon the issues dealing with state and national security. The author outlines the following issues: sovereignty, Russian regions’ independence, the aspiration of many peoples and ethnic groups for national consolidation, and socio-economically determined integration processes in the Russian society. The author carries out the analysis of the problems coming from the specific interests of peoples, which manifest themselves during the ongoing reforms, and the necessity to coordinate them, to search for compromises in the process of coordinated implementation of economic, political, and social reforms on the whole territory of the Russian Federation.

Abstract:
The article analyzes the development of immigration legislation of Russia in the sphere of foreign labor force regulation in the post-Soviet period. The authors conclude that for foreign nationals from the countries with a visa entry system the order of a work permit acquisition hasn’t significantly changed; while the procedure of execution of work documents for foreign nationals from the countries with a visa-free regime has been a chaotic process. The result of almost 25 years of attempts to find the most appropriate models of migrant workers job placement is rather disputable. Among the key achievements of a modern legislation are: 1) possibility of legal employment of foreign nationals from the countries with visa-free regime at physical and legal persons under equal conditions; 2) abolition of a quota system of employment of foreign nationals from visa-free countries. As the main shortcoming of it the authors note the orientation at migrant workers from visa-free countries while the migration from “visa countries” also has a big potential. For scientific explanation of the existing quota system low efficiency the authors offer the methodology of assessment of Russian labor market need for a foreign labor force which corresponds with labor force shortage and is defined as a current demand for labor force after deduction of its supply with the division into professional groups. On the base of the proposed methodology the authors analyze the labor force shortage discharge in Russia with foreign labor force in 2012 which allows concluding that the existing work permits for foreign nationals did not comply with the real need of Russian labor market. Consequently, the methodology of the need for foreign labor and the quota system assessment established by the existing migration legislation (since 2015 – only for the foreign nationals of visa-free countries), doesn’t reflect a real need for foreign labor for labor force discharge in Russia. In the conditions of a limited information and statistical provision it is suggested to use the proposed methodology as a base for work permits quotas formation for the foreign nationals from visa countries. In order to realize a positive potential of labor migration, to solve economical tasks of innovative development and to moderate the imbalances on regional labor markets the authors offer to introduce a new differentiated approach to the attraction and use of foreign labor force both from the visa-free and visa countries. The authors offer a catalogue of the most wanted specialities as an instrument of selection of the most wanted labor migrants.

Abstract:
The author describes certain specifics of the prosecutors’ work during the active phase of the counterterrorist operation in the Chechen Republic, cites the number of the dead and injured prosecutors (as of May 2005), talks about the interaction an coordination of actions with the military prosecution office, the command of the United Group Alignment in the Northern Caucasus region, gives a detailed description of the nature of the tasks performed by prosecutors and investigators makes conclusions about the necessity to declare the local prosecutors (at least 1,000) combat veterans. The author uses the comparative historical and statistical research methods which help to better identify the role and importance of the activities carried out by the regional prosecutor’s office of the Chechen Republic during the active phase of the counterterrorist operation. The role and importance of the activities carried out by the regional prosecutor’s office of the Chechen Republic during two armed conflicts of non-international nature is not sufficiently researched. However, the work of the prosecutors and investigators of the prosecutor’s office of the Chechen Republic was of great importance to the restoration of the constitutional order in the republic, holding the referendum on the Constitution of the republic and elections of the first President of the Chechen Republic, protection of the constitutional rights of the person and the citizen.

Abstract:
The work concerns conceptual and theoretical fundamentals of the understanding of the national security in the context of globalization with due respect of the biosocial nature of the human being. The object of studies involves demographic security as one of the types of national security of the state. The authors study the main social and demographic problems in Russia, which threaten the demographic security: depopulation, loss of territorial integrity and social-cultural identity due to the pronounced social and economic atomization of the society. The results of the study show the topicality of the further social and demographic studies. The article contains results of the studies, which were held in the Vologda region by the Institute of the Social and Economic Development of the Territories of the Russian Academy of Sciences. The researchers hope that based upon the experience of organization and holding of sociological studies with the use of original methodology and comparative analysis they have managed to get the results regarding the said problem. The principal specificity of the concept of this research is purposeful self-limitation of study to the demographic aspect of a more general problem, while using other aspects as context and further objects of studies. The main social and demographic problems of the state involve low birth rate and high death and illness rates, the forecasted "return" of natural loss of population by 2020, loss of population in the Central and North-Western parts of Russia, which is especially obvious in the rural areas, demographic ageing of the population and considerable differentiation of the incomes.

Abstract:
The author of the article puts forward arguments for basing state anti-crime policy on criminological findings. To the author's opinion, this is the key to success of the Russian federal security service and the fight against terrorism and terrorism financing. The author describes special feautures of the influence of the external factor on terroristic crime and focuses on the problems of detecting the sources and channels of terrorism financing based on the results of criminological researches.

Abstract:
The article contains a sociological research analysis of data regarding problems of reproduction of such social risks as nationalism, extremism and xenophobia. Conclusion that extremist practices are present in all spheres of social life and have universal non-specific character was made basing on data from the six regions of Russian Federation. It is revealed that the contents of such indexes as attitudes towards representatives of other nations, fear to be a victim of national hostility and sense of national hostility has regional specific features. It is possible to mark a disposition of respondents towards estimating high probability of terrorist acts in their place of residence without any connection with the rational security estimation.. The fear of terrorist act and evaluating its possiblity are the interconnected variables. Generally, the perception of possibility of a terrorist act is determined by psychological causes.
