M.G. Smirnova Judicial Law-Making as a Form of State Activity: Current Status

Abstract: The article deals with judicial legislation and the possibility of recognizing the lawmaking functions of the court. Judicial legislation is caused by the need to fill the gaps in the law, clear collisions, specify vague provisions. The author comes to the conclusion that judicial legislation is objectively necessary and effective.
